Terms of Use

The rules for using batonrougeseptic.com. Please read them carefully before using the site.

Agreement

These Terms of Use (“Terms”) are a legal agreement between you and Baton Rouge Septic (“we,” “us,” “our”) governing your use of the website at batonrougeseptic.com and any related pages, forms, tools, and communications (together, the “Service”). By using the Service or submitting a quote request, you agree to these Terms. If you do not agree, please do not use the Service.

What the Service is — and what it is not

Baton Rouge Septic is a marketing and lead-referral service. We publish information about septic systems and connect homeowners in the Greater Baton Rouge area with independent, licensed Louisiana septic contractors, and — when you request it — with third-party financing partners.

We are not a licensed septic contractor. We do not install, replace, pump, inspect, repair, or otherwise service septic systems ourselves. We do not employ the contractors we refer. When you hire a contractor introduced through our Service, your contract is with that contractor, not with us.

We are not a lender or a mortgage broker. Any financing information we provide comes from independent third-party lenders. See the Financing Disclosure page.

Who may use the Service

You may use the Service only if you are at least 18 years old, are a property owner or an authorized agent of the property owner, and have the legal authority to request work on the property. By using the Service, you represent that you meet these requirements.

Communications and consent

By providing your phone number and email address, you consent to receive calls, text messages, and emails from Baton Rouge Septic and from the independent contractors and lenders we refer you to, as described in the TCPA Consent page. That consent is not a condition of purchase and you can withdraw it at any time. Instructions for opting out are on the TCPA Consent page.

Content on the Service

The articles, guides, cost ranges, and other content we publish are for general information only and are not a substitute for a professional site inspection, permit determination, or legal advice. Actual costs, timelines, permit requirements, and system suitability depend on your specific property and are set by the licensed contractor and the applicable parish and Louisiana Department of Health rules.

Intellectual property

The Service — including its text, logos, layout, and code — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, distribute, sell, or use the content for any commercial purpose without our written permission.

No warranty on referred contractors

We take reasonable steps to identify licensed contractors, but we do not vet, employ, supervise, or control them, and we do not guarantee or warrant their work, pricing, timelines, materials, safety practices, license status on any given day, or insurance coverage. Before hiring any contractor introduced through the Service, we encourage you to verify the contractor’s license with the Louisiana State Licensing Board for Contractors at lslbc.louisiana.gov and request proof of insurance. No guarantee of financing

If you ask us to connect you with a financing partner, approval, rate, term, and loan amount are determined solely by the lender and depend on the lender’s underwriting criteria. We do not guarantee that you will be approved or that any specific rate or term will be offered. See the Financing Disclosure.

Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy of information. We do not warrant that the Service will be error-free, secure, or free of viruses.

Limitation of liability

To the fullest extent permitted by law, Baton Rouge Septic and its owners, officers, employees, agents, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunities, arising out of or related to your use of the Service, whether based on contract, tort, statute, or any other theory. Our total liability to you for any claim arising out of or related to the Service will not exceed one hundred U.S. dollars ($100). Some states do not allow the limitation of certain damages, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Baton Rouge Septic and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, (c) any information you provide, or (d) any dispute between you and a contractor or lender introduced through the Service.

Governing law and dispute resolution

These Terms and any dispute arising out of or related to the Service are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. You and Baton Rouge Septic agree that any dispute that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. You and Baton Rouge Septic each waive the right to a jury trial and the right to participate in a class action. Either party may still bring an individual claim in small-claims court if the claim qualifies.

Subject to the arbitration provision, the state and federal courts located in East Baton Rouge Parish, Louisiana have exclusive jurisdiction over any dispute not required to be arbitrated.

Changes to the Service and to these Terms

We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We may also update these Terms; when we do, we will change the effective date at the top. Continued use of the Service after changes take effect means you accept the updated Terms.

Termination

We may refuse service, suspend, or terminate your access to the Service at any time for any reason, including violation of these Terms.
